Former President Donald Trump’s second impeachment trial is set to begin this Tuesday. The Senate will vote whether or not to convict him on “incitement of insurrection”.
It is likely Trump will be acquitted as a super-majority is needed to impeach him which would require many republicans plus all democrats to vote to impeach. The House already impeached Trump on Jan. 13.
The House will appoint managers as prosecutors who will be on the Senate floor along with Trumps lawyers. The prosecutors and Trump’s defense team will have a set amount of time to make arguments, and then senators can ask questions in writing before a final vote. The Senators will then stand up and cast their vote for either guilty or not guilty.
Trump’s first impeachment trial months ago lasted 3 weeks but this one is expected to be a lot shorter. Trump’s lawyer is a religious Jew who has sent a written request to Senate Minority and Majority leaders Mitch McConnell and Chuck Schumer. In the request the lawyer asked the trial be paused if it leads into Sabbath. The lawyer said he will have to leave Friday before sundown until Sunday and weather or not the Senators grant his request he will not remain there over sabbath as part of his religion.
Republicans and Trump’s lawyers argue that the trial is unnecessary, and even unconstitutional, because Trump is no longer president and cannot be removed from office. Democrats however disagree stating that without impeachment Trump has the ability to run again for office in the future. If Trump does get convicted the Senate may take a second vote to bar him from holding office again. The fresh memories of Jan. 6 may make it easier for democrats to make their case, but it’s still very unlikely Trump gets convicted. Trump was acquitted last time he was impeached and only 1 republican voted for impeachment. On Jan. 26 every republican Senator but five voted to dismiss the trial. Any Senator who thought a trial shouldn’t happen will likely not vote to impeach the Former President.
